About the Role

As Pre-Contract Senior Commercial Manager based at our HQ in York, you will be performing the commercial function of reviewing and negotiating all contract documents received from clients and suppliers. Reporting to the Commercial Team Leader, you will work as part of a small team supporting others and reporting on the status of projects for which you are responsible. You will be required to review all contract documentation received by TSP Projects, both pre and post-tender stage and advise the business on the acceptability of any proposed agreement by projecting the commercial and legal interests of TSP Projects.

Negotiation is key in reaching agreements on contract terms for each project before seeking Director approval/sign off, by highlighting the risks, requirements, liabilities and obligations of each contract entered into and report these to the Project Delivery Teams.

The Commercial team is growing in line with business expansion which can support career progression.

Our current contract values are between £50K and £5M.

Accountabilities & Responsibilities:

  • Ensure agreed payment terms allow for regular invoicing with the shortest possible payment cycles
  • Review insurance requirements of all agreements and ensure contractual obligations are covered by TSP Projects’ policies
  • Negotiate terms which maximise fee for additional work
  • Client facing and maintain good relationship with commrcial counterpart on each project
  • Liaise with the engineering disciplines to understand the inherent risks on each project and how these can be reduced through contract negotiation
  • Prepare documentation detailing any security requirements (e.g. performance bond) to issue for board approval
  • Produce a report upon completion of negotiating the terms of an agreement, to be issued to the Project Delivery Teams, highlighting the contract’s key issues and administration requirements
  • Answer all contract and insurance related queries
  • Present commercial awareness training to the business when required
About You

Essential:

  • Demonstrate Continuous Professional Development (CPD)
  • Quantity Surveying, Commercial Manager or similar construction law related degree. Ideally MRICS or working towards
  • An understanding of commercial risk and an ability to identify which clauses need to be addressed
  • Excellent contract awareness - will be required to negotiate various standard forms of contract and bespoke agreements
Desired:
  • Preferable experience working with Design Consultancy Agreements
  • Ability to work across various sectors however this would predominantly be rail
